    talking to ebay now, they are refusing to honour it. I timed my purchase and placed a bid during the original offer. But they are just saying "we may roll-out new promotion in near future. Hopefully you will be able to avail that offer."

You were lured in by the offer and then promptly shafted by the fine print that they can end the promotion early. The definitely should honour the promotion in cases like this.

      • If you read the comments in page 16, people where getting the 15% back by contacting ebay, eBay's done that in the past. Look up their 20% discount code which was American exclusive buy was working on AU website and as a result the code reached its limit. E bay cs offered refund for the 20% . I only negged because ebay was being dodgy.

          @hockysa: I'm just responding to you on this 'you only get to enter the code after purchase' :). eBay had a little notification banner on the site that the deal had ended (though it continued to work for many hours after), however I agree it was not a good move for them.

      I was about to purchase $1000+ of goods after I'd come home from work today, only to find that your CELEBRATE2015 promotion has ended early, apparently because "There is no balance left on this promotion code".

      Yes I already understand that your terms & conditions allow you to cancel promotions like this prematurely, but I feel compelled to give you some feedback on how poor form it is to do something like this at this time of the year.

      This is a complete and utter cluster f**k up on behalf of your marketing team.

      First of all, how could you possibly underestimate the interest in the promotion and run out of budget to continue the deal until the originally advertised date? Surely a blue chip like eBay would / should know better than this!?

      Secondly, pulling a stunt (or shall I phrase it as pulling a rug under your customers' feet) at this time of the year? Really?? Marketing genius right there!

      Thirdly, eBay refusing to honour the promotion for customers who have already committed to buy goods via eBay solely on the premise of the deal is completely illegal in Australia. Thankfully I am not in this category but I really feel for people that are, especially at this time of the year. But then what would eBay know about any of this.

  • I really thought I have up till 31st December and believed the AD they put out in full good faith. There were so many things I wanted to browse before making my final purchase. Now I just save my money and leave it in my wallet.

    This is not the first time I get upset with ebay, the last time my seller in USA used eBay's Global Shipping Priority service and I did not get anything until 21 days later and it was a 300 grams item for which ebay charged me $38 for shipping that took 21 days. Not only that when it finally arrived, ebay shipping company Pitney Bowles ripped off the box, threw away and then repackaged my purchased with brown paper with the manufacturer box all thrown away. Without my permission.

    May ebay always lose out to Amazon forever and ever and may they end up like yahoo one day, unable to compete with anyone because they have absolutely nothing to offer. May people all support Amazon and make sure Amazon grows bigger and bigger.

    Spoke to online chat with 3 different people and they have all said they will not honour the discount - Unlike what some others have said on here. So I would be careful if this is your plan.

      It's a gamble, don't even try it unless you have confirmation to make that purchase.

      Otherwise you'll pay full price for items and eBay will end up profiting from your misjudgement.

      I think we should all boycott eBay:

      1. Buy direct from retailers
      2. Buy from local online retailers
      3. Buy from other reputable sites e.g. Amazon, Alibaba or even gumtree

      eBay does not care about sellers, they allow scammers to thrive on eBay.
      Now they don't even care about the buyers.
      So why should you give them your money when they will hold you in contempt?

      Dear ACCC,
      online shopping giant eBay advertised a 15% off site wide sale, prompting a number of sellers to list items, people to add items to their electronic shopping carts and watch lists. The sale was advertised to end midnight on 31 December and was an end of year "celebrate2015" promotion. I spent a considerable amount of time researching goods to buy, asking a seller questions awaiting reply, saving items to my watch list, only to discover the sale suddenly ended early at 1pm AEDT 30th by sudden "revised terms and conditions". The prices no longer eligible to attain the discount. The sale was capped at a max of 2 transactions per account, and a max of $300 discount, so eBay should have been aware of the maximum magnitude of expenditure on promotional discounts. The move to end the promotion early sparked outrage on forums for consumers who had their time wasted by misleading and deceptive conduct, possibly also bait advertising. If this sort of behaviour is not against the Act, it should be, regardless it is just bad business, accordingly a lot of disgruntled consumers are seeking a remedy.

      I'm glad I didn't personally pay for listing fees to sell items during the promo as I'm sure many did. I just had lots of my time wasted and goods unable to be bought for the advertised price discount.

      Consumers would be eager to hear what can be done and what response they can expect from eBay in this scenario?

          Ebay isn't exactly like a normal store where you just buy things. It has auction items, which lock users into a commitment to buy an item if successful. Since they created the promotion with the implied intention of letting it run for 3 days, people proceeded to lock themselves into auctions that would end within the 3 days so that they can make use of this discount. Now that the discount has ended, they are still locked into these auctions and when the auctions end they are liable for the full price without the anticipated discount. A normal store doesn't have such lock ins. Therefore there must be greater expectations of Ebay to take into consideration these locked in customers.

          The terms and conditions should have said that the deal is subject to a maximum discount pool of $X. That would imply that the deal is subject to limited funds and not dependent on a limited time/date. You're right that it wasn't necessary for them to do so, but not doing so shows bad faith.

          On the other hand, how did they advertise the change in terms and conditions? Was there a warning saying "PLEASE NOTE THAT THIS SPECIAL COUPON WILL END AT [INSERT DATE/TIME]". Or was it the same banner with a link to the terms and conditions with the revised date/time and therefore people had to dig around to find out about the changes. If there's been a change in the fine print then they should (must?) clearly show that change in the fine print. Not hidden in some hyperlinked page to the changed terms and conditions itself without attention being drawn to the change itself.

          You would also have to consider when exactly they updated the terms and conditions? Did they update them half an hour, an hour or a few hours before expiry, and then allow an extra 5 hours before closing it off completely? They advertised it for around 24+ hours, and then just give a few hours warning for closing? The amount of notice given for the deal closure seems disproportionately insufficient.

          @ScaryZombie: I think those impacted by auctions are the ones that have been put out and have a very legitimate case to make a complaint. As you noted, they got locked into a transaction (or sellers listed items) assuming a sale would be subject to the promotion, and now it's ceased they have no viable out. If the buyer does somehow get a bid cancelled, then the seller loses out.

          The people with full carts were inconvenienced, but in some regards they were already making a gamble by sitting on a cart given stores control stock and could adjust prices. Look at how many of the posted deals sold out or had price adjustments over 24 hours resulting in people missing out despite the 15% code being active. I still feel for this lot, but certainly they're at less of a loss to those with ongoing auctions and on the plus side they aren't at a financial loss, even if it's no doubt upsetting.

          Ideally the code would still be valid for auction sales where a bidder entered any bid while the 15% coupon was active, even if it remains expired for other sales.

          well the email stated 31 Dec & other t&c's, but no link to these other t&c's. A reasonable person would assume that the promotion was for a fixed time, not changeable depending on whatever marketing decided. It wasn't spelt out in the email, there was no follow up email advising of any changes to the date. It's bait advertising (they cant even claim there was limited stock which was sold). Its misleading. Its deceitful conduct.

          The error message indicates they had a set budget & they reached it, so they could have & should have indicated "until 31 Dec or until $x of sales are reached.

          It's not like they're some small shop without any idea how successful their marketing stategy would be.

          I don't think it is a certainty that eBay didn't break the law, it's questionable. Terms and conditions are about contract law, whereas consumer protection laws have a whole lot of other legislative protections that go beyond this, the crux of which is whether the ordinary person would have been misled or deceived by their actions. For example, a pub offering a car giveaway in its promo advertising had in its fine print that it was actually only a 1 in 100 chance of a car for the winner by spinning a wheel. Despite that been written in the terms, that was deemed irrelevant by the Court and they were ordered to give away the car because the terms and conditions were not clearly displayed / attention drawn to them and other people gave evidence that the advertising led them to believe that a car would be the prize for the draw which was contradictory to the fine print. The courts even take into consideration whether the font was smaller on an advert to deliberately hide key terms.

          You say they weren't misleading, however people on this forum are saying they were misled.

          It is probably true that I, having only had my time wasted by them, probably have no remedy to receive from them. You may be thinking about it from this perspective. However consider a seller who listed additional items for sale and paid listing fees would have as they were duped into participating in a sale on eBay only to find the deal was cancelled and so disgruntled buyers like me no longer bought their items. Shouldn't they be entitled to their fees back? Surely the law caters for this.

          Furthermore, buyers that bid on items or committed to buy before the promotion ended would have have cause for remedy if they were mislead into thinking they would get a discount.

          Businesses in trade and commerce can't change terms and conditions after the transaction has been entered, some people like myself actually scan read the first terms and conditions before starting shopping, so the question would become whether sufficient attention was drawn of the revised terms and conditions prior to committing to enter a transaction after seeing it first time.

          As for the consumer protection laws you refuted were not breached, this is from the ACCC website:

          Creating a false or misleading impression: Businesses are not allowed to make statements that are incorrect or likely to create a false impression. This rule applies to their advertising, their product packaging, and any information provided to you by their staff or online shopping services.It also applies to any statements made by businesses in the media or online, such as testimonials on their websites or social media pages.

          Fine print and qualifications: It is common practice for advertisements to include some information in fine print. This information must not contradict the overall message of the advertisement.

          Bait advertising: Bait advertising takes place when an advertisement promotes certain (usually ‘sale’) prices on products that are not available or available only in very limited quantities. It is not misleading if the business is upfront in a highly visible, clear and specific manner about the particular product ‘on sale’ being in short supply or on sale for a limited time.

          ….
          The latter is my main point, eBay should have been very clear that the sale was limited quantity and time from the start, it seems they weren't as people were given a false or misleading impression it would continue until year end at midnight. The original advertising made the end date clear as such and if it was in the fine print that it may end early it was contradictory to this main advertising impression (and if it was in the original terms, why did they have to revise the conditions?).

          I did not have time to hear back from a seller about postage fees for an item, so I believe 5 hours is "sudden" and insufficient in the context of online shopping where transactions take place over a sometimes drawn out process of correspondence. Their auctions run for days with bids still committed for that duration, again 5 hours is sudden in this context.

          Hypothetically, Imagine if they released revised terms for fees stating they would now be charging a 50% commission on sales with 5 hours notice and you were at work and didn't see it and your item then sold and they took half of your proceeds, wouldn't you think that was sudden and want to challenge that, given insufficient time was given to review before the transaction was completed? Sounds like a dangerous precedent to set.

          I therefore do not believe I am "simply wrong" - when it comes to the law, it's never simple and it's never black and white.

      • Totally agree. Believed it ended midnight the 31st and was waiting a response from a seller after much research etc. Went to purchase and found out like everyone else that it had expired. Becoming the norm from a lot of the big companies to just shaft at will, eb, JB etc. So many horrible experiences recently and now ebay. Problem in AUS is that we lack the population for any competition. With the weak Aus dollar it's harder to buy from overseas plus they will eventually tax that. With the monopoly like situation here the companies can shaft and know there will be no consequences as where else will you go, especially if a company has the buying power for exclusive rights etc.

      If you look hard enough, there are other alternatives besides ebay.

      I was going to buy some IT accessories.
      After the big eBay bip up, I went to compare prices with some well known retailers such as CPL, Centercom and MSY.
      I found the margin of savings to be minimal even with the 15%.

      But of course, some items will have a much higher margin of savings e.g. Nikon D3300, selective TVs and some graphics cards.
      With TVs, most of the time you'll be able to haggle for a better deal in retailers such as JB.

      This should not be the case if they specifically tell you when they will honour the deal until. Rather than buying a few ad hoc items, I was spending heaps of time collating a large shopping cart spend. How'd anyone get away with this in a store? Walk into store with a 15% off sale sign outside of it saying "ending tomorrow". Walk around putting things in your trolley, get to the counter "sorry, we revised the sign out the front 5 minutes ago, you have to pay a higher price than advertised now". That is Bulls..t.

          This is beside the point. I asked a seller a question about an item and was awaiting a reply. As they didn't reply immediately, I had to go to work. Came home to check the response and finish the cart under the impression there would be no harm in leaving it for an answer about whether to add that item as well due to the advertised completion time, only to find it had finished early. I would have bought the other items had sufficient notice been given. The nature of asking questions about postage etc through enquiry forms means sometimes it takes some time to complete the shop, so just like they don't respond within a few hours, they shouldn't change advertised promotion conditions in that timeframe either.
