If the key is fake, wouldn't Microsoft be able to detect it eventually with windows updates? My one is still updating fine, they even allowed me to upgrade to windows 10 for free so I doubt it's illegitimate.
Actually it is technically illegitimate, because under the EULA these are pretty much as good as piracy. But the key itself isn't illegitimate e.g. it will activate, just the way it was obtained is not legit.
There is other ways to still get Windows 10 by breaking the EULA and its free. Just search the web, plenty of alternatives. For example upgrading using:

Why pay another company to break the EULA for you for a price, where as you can break it yourself for free? LOL!
Fake - not likely. Illegally obtained and resold - most definitely.
