      We aren't / weren't even customers of the bank & weren't personally offered $50 (it was unauthorised excerpt from a targeted email, promoted as a deal by OP - who could be liable for any action).

      The first thing to do is lodge a complaint with the bank. This will likely be rejected based on IMB's email response. Then the FOS.

      If you then proceed to legal action, you need to prove you do have legal standing to mount such a case. I highly doubt you could show it, based on the above conditions.

      Class action (representative proceedings here) may be easier in other countries, but not widely used here.

      At what cost for the legal team, court costs, etc… (Generally cost thousands per person up front. The settled legal fees in the recent detention centre class action was over $20M.)

      For a claim of what… $50 each - what you incorrectly thought you would receive from IMB, based on what you read on OzBargain.

      And after spending all that time & money taking a class action, class representatives may have an adverse costs order made against them if they lose the case… which could be very expensive.

        Just let them do whatever if you think they're wasting their time. Obviously that person doesn't really mean taking class action, he just didn't know where to go to complain.
        You've commented so much here and seems like the time you've spent commenting in this thread far exceeds the effort and time it'll take people to lodge a complaint to the ombudsman.

        • As in many failed deals, people say they will lodge complaints - venting but not following through. Just useless!

          I always encourage people to know their rights & complain where appropriate. But first approach the business with your complaint.

          I follow through if I have a strong case (this case is so weak) & the time spent lodging a complaint is less than I could earn by not complaining, or is in the public interest. You've got to pick your battles.

          In this case bad PR will most likely have the greatest success. I posted above IMB Facebook address.

          My 1 legal action against a business showed me it is unlikely that a successful outcome will be worth the long battle, despite winning all I claimed including compensation. The company apologised & agreed to changing it's customer relations & staff training (a large expense for them), the staff member who initiated the issue was in tears & feared she would lose her job (she learnt the consequences of her unjustified actions), I paid for a nice holiday with the payout… but ultimately it wasn't satisfying.

          Fortunately, the approach I used set a precedent (not under law as case was settled out of court) others have used to fight similar cases. As it was seen as a test case, a State Government Department provided support & advice, and had support from a section of the business community who were sick of the practice tainting their reputation - without which I would never have started my fight. But I took on the case without lawyers & fought it myself.

          People often say they will take on a case without understanding what that entails. Talk is cheap.

        You can "WIN" by lodging a FOS case against them, its free for us, they get a automatic investigate charge MORE than the $50 they don't want to pay

        If at least 500 people of the 1000's that signed up, would be a massive cost to them

        I am doing it as soon as they confirm they are not paying the $50

        I will also continue to keep IMB employees "busy" with constant phone calls and emails for them to respond.

          I wish you well in your fight if you plan on doing all that.

          I'll wait for the 5th, and if no $50 I'll lodge a complaint with the bank and then follow through with a complaint to the FOS. If nothing comes of it I'll move on knowing the FOS complaint probably cost them more than the $50 anyway so it will be their loss.

          The FOS is very unlikely to become involved in any complaint into a bank competition as it would likely be outside their scope of investigation.

          Just because someone posts a private email from a Bank without authorisation as a deal, that was targeted only to those who entered the Mini competition, does not mean anyone can make a claim or expect a reward from that offer.

          As I have pointed out, IMB will likely be monitoring these posts & directing threats of extorting money from the Bank by using the FOS complaints process to the Ombudsman. Vexatious complaints are unlikely to be raised with the FOS.

          The likely outcome is to bring the reputation of OzBargain into disrepute.

          Thanks for the advice. You've made your feelings on the issue very clear in many posts, however I'll proceed as planned regardless of what your opinion is on how the ombudsman will view complaints made by people relating to this issue.

          The offer comes up after a simple google search of "imb $50 mini" And if you searched that via word of mouth you would have come to a page that said nothing originally about it being only for people that entered the competition. Imb changed the conditions after Ozbargain. They are in the wrong.

          Reading the search you suggest…
          The first one I saw was from IMB
          "If you entered our Win a Mini competition you will get a $50 bonus1", which is their updated page including the requirement to have already entered the Mini competition - as you correctly point out. So many people visited that site!

          The next are from OzBargain or are reposts of this OzBargain deal.

          If you know what to search, there are many sites available online - but without the original email as a starting point, no one else looked & posted this as a deal. I doubt many have found their way there by accident.

          The link in this deal was sent by IMB only to those who entered the Mini competition.

          IMB stuffed up majorly (they should have ensured only those qualifying for the promo could access the site we went to), but the promo as part of a competition some people entered was supposed to be open only to those people. IMB promo team would have only budgeted for & got approval to spend a maximum of $50 x less than 5000 who entered the Mini competition.

          To ensure that, IMB have now simply checked those attempting to open a bank account using the code "mini" against those sent the offer in emails, and refused the $50 to those who weren't invited. My opinion is this would likely be outside the scope of the FOS to investigate, but we'll soon know for sure.

          Like all businesses, IMB can restrict entry to their own promo. (A bit like showing an invite to the bouncer on the door of an event - they should check your name against those invited & validity of invite, rather than accept you should come in because you say you're invited & there were no t&c on invite they found saying you may be rejected if not legitimately invited.)
          Those originally entering their competition would likely have agreed to IMB's t&c which we haven't.

          IMB has felt the force of this site. It will have already cost them dearly. Their lawyers & PR people will be well paid to fix this issue. But it could have been avoided by inserting the conditions of entry to the competition in the original linked page or a way to restrict entry to site. IMB will have learnt from this.

          The posting of the link contained in a private email from the Bank without authorisation as a deal has led to disappointment. This type of thing has happened many times on OzBargain :-(

          Hopefully we'll be more wary & less expectant of a happy outcome in future 'too good to be true' deals like this.

          (I was wary… but opened an account via this promo, just in case. But I have been personally attacked for pointing out when popular deals would not be available to us as the offers were only available to those directly receiving it from the promoter - a pretty usual practice.)

    so many people here got cancellation emails or declined ones? be interesting to see whether

    1. people who received cancellation emails used the ozbargain click thru redirect (I went direct to the IMB site)
    2. location (because im very much the geographic for this bank and have family banking with them etc etc)

    • I haven't received a letter, and no card either. I transferred money to the account the other week and it's showing up under current balance, but the available balance is showing $0.00 even though the account status is showing open. Sad thing is I would be using this account if they sent me a card and gave me the $50 instead of being dicks and trying to get out of their mistake.

      Then a call on 22/6 from IMB to check account is ok & to set up telephone banking & invite to pop into branch, email with phone banking set up, same congratulations letter resent 22/6…

      But no ATM card.

    Nothing in my account either. I have lodged a complaint with IMB and will give them 48 hours to respond (no doubt with their generic response about needing to have entered the MINI competition) and then will lodge my complaint with the FOS and move on.

      giving them til 5pm and lodging my FOS complaint. Sure it wont mean much, but they have (profanity) everyone around.

        • @Phalaxis: The problem was I opened an Everyday Unlimited Account rather than an Everyday Account. The Unlimited charges you account keeping fees for balances less than $2,000. Solved this though by calling up and converting the Unlimited to an Everyday and then withdrawing.

    Lodged a complaint with the FOS. Haven't got a response from IMB yet but it appears my internet banking has been made unrestricted so I can now transfer money out of the account, and possibly a card is on it's way, however no $50 yet.

    Will see how it plays out but they've got until the 19th of Aug to contact me about it.

    Received a welcome email from a branch today, so they haven’t closed the account as suggested by their last email.
    Would prefer the $50 I’m owed.

    Made a complaint on the website with a threat to go to FOS and got the money within 2 days.

      • Here's the sequence of events for me:

        Made a complaint on the online link
        Got an email saying I don't qualify and that I can cancel if I wanted to
        Requested the matter be escalated into a complaint (for the purposes of FOS I believe you need to formally lodge a complaint and provide 45 days before they intervene)
        Got another email saying I don't qualify
        Attached the terms and conditions from the page earlier, and highlighted that it does not state that I don't qualify
        Money hits the account 2 days later with no further replies from them

        • I'm not sure on the specifics and what entails a complaint versus just a general enquiry, but I guess once I mentioned the word 'FOS' they buckled pretty quickly.

    • They sent me my member number in the initial email straight after applying. From that you can reset your password and login.

    Alright so one of their consultants just hung up on me. This is possibly one of the worst banks I've ever dealt with. Terrible customer service and unwilling to honour a promotion.

      Yep they've cut all contact with me and simply ignore any emails I send. Even sent one simply asking if they could confirm if a card has been posted out to me, and they ignored it.

      At least now that there is evidence they've paid the $50 to people who they originally claimed were ineligible, so it should add some weight to the claim. I am more determined than ever to see this to the end now and will be updating my FOS dispute to include them paying those who they claimed were ineligible, and them refusing to have any communication with me to this point.

      I was keen to keep using the account and they probably would have made their money back over time, but they are being like petulant children because people are pushing them to hour a deal that they didn't manage properly, and so now as soon as the money goes in, it will be going out and so will I.

    If there was any question about why this institution is so small after 120years in operation, it's their small mind, small outlook. They cant see the bigger opportunity just up the road.

  • After lots of emails back and forth after a complaint was made, they have apparently scrutinised my account and come back and said I signed up for a Rewards Saver account, which isn't one of the listed accounts in the promotion.

    Oh well, lost cause for me, pretty sure I signed up for an Every day account but I guess I screwed up.

    • The exact same thing happened to me and I eventually just messaged them to close my account after they told me that. I had thought I opened an every day account though originally also.

      • Is it possible the are changing accounts on us? I could have sworn I signed up for an every day account, but checking through all my signup emails there is nothing to state that which is strange in itself.

    I rang up yesterday to update my mobile number, and they told me I can't do it over the phone and they have to email me a form, which I have fill out and post back to them in Sydney (I'm in QLD) along with a copy of my drivers license and a bunch of other ridiculous bullshit.

    Pretty sure they are just making things as difficult for me as they possibly can because I made a FOS complaint, so I've given them until the end of the week to update my mobile number or I'll update my FOS complaint and increase the amount of compensation I'm asking to cover all my costs and time spent dealing with their bullshit.

    These guys are a disgrace I've never seen anything like it with any business I've ever dealt with!

      No response from them by the end of the week as expected. Waste of time trying to contact them about anything so just going to update my FOS complaint first thing Monday and increase what I'm asking for, and will wait until this one is resolved next month then open another dispute about them refusing to update my mobile number.

  • Received a "Sharing is Caring" offer in mail today - get a friend (New member) to sign up by 28/8/17 & you & friend receive $50 in accounts.

    But t&c include:
    Original voucher must be presented in person at IMB branch or by FAX to IMB DIRECT (FAX both sides of voucher after ringing the bank).
    1 voucher per member.
    New account must be opened with minimum $50 held for 1 month.
    Paymant made 4 weeks after verification…

    ING referrals are so much easier!

    I went to close my account yesterday, and he took two seconds to do it, normally it's instant so I checked it after the call and still open. I thought maybe it takes some time, so check it later in the evening, still open. So I check it this morning and still open! Lol. Oh the incompetance of this bank is truly staggering, they can't even get a simple account closure right. Why would anyone trust them with the deeds to your property! Or even your savings.

      I lodged my complaint on July 17th, the response said IMB have until September 1st to reply. I'd be happier not hearing from them and getting the $50.

      in other news, I still don't have an ATM card two months later? I added that to my FOS complaint also, why am I being charged 6 dollars in account keeping fees yet they seem unable to send out something basic like an ATM card

    • That's probably why I haven't seen my $50. I told them I had been planning on using the account as my primary bank account, but after their disgraceful handling of this I would be closing it immediately after I get my $50.

      My letter will probably be the same, without the last paragraph. Guess I'll have to keep arguing the case with the FOS because in any other situation they would have argued the promotion was subject to the terms and conditions, only this time they screwed it up and now claiming a sentence on the promo webpage negates the terms and conditions.

      IMB says a lie in the letter,

      It was clear in the body of the original copy of the webpage before any amendments were made in the statement that stated:
      "And just for entering our Win a Mini competition you will get a $50 bonus…"

      It was after the amendments, and no that word before the amendments.

  • question about lodging FOS compliant. have contacted FOS a lady told us to send an equiry directly to IMB which we did about 2 weeks ago. FOS lady then told us suppose to wait for a 45 days to get a response from IMB before lodge a formal dispute to FOS, we yet got reply from IMB and don't think they will. so how did you manage to lodge a dispute so early to FOS but not waiting for 45 days from IMB to reply first?

      It's great to have you on board. We notice that you opened your account using the promotion code MINI. We have reviewed our list of eligible entrants who entered our Win a Mini competition and, unfortunately, you're not on the list so are ineligible to receive the offer.

      I just used that as my basis for lodging a complaint directly with the FOS because it was pretty clear from that email that IMB weren't going to honour the promotion. The FOS response to my complaint stated IMB had 45 days to respond, within 2 weeks I had the $50 deposited.

    I just remembered about this deal and after reviewing most of the people receiving their $50 credit .. i have now made my FOS complaint. Hopefully a positive outcome :)

      In the email from FOS i received IMB has until August 29th to respond before FOS steps in.

      But what is working in our favour is the letter IMB starting sending out (linked above by Jonesy7707). They claim some false eligibility crap in the letter and a sign of good will they will credit the $50 anyway. So they cannot give the money to some people and not the rest.

      So everyone who hasn't complained with FOS yet .. do it and link that letter. We should all definitely get our $50 credit :)

      I haven't received an ATM card either. My account is active and I did receive the welcome email. I didn't think this account had any account keeping fees?

      Still no response from IMB for me. They do have until August 29 to get in contact though.

        received the mail today same letter as @jonesy7707. not need to worry you will sure get the credit but those customer service gesture comment are all but faking how good they are anyway. IMB worked out legally can't get away with it if customer make FOS compliant. one way or other best to paid the bonus for customer

    Lodged a complaint with the FOS on August 3rd for my wife's account and the $50 was deposited today. That's 2-for-2 bonuses we managed to get deposited.

      have you transferred yours out at all? I just tried via the app it just says "SYSTEM ERROR OCCURRED" almost as if they have some sort of block on the account

      I only got $44 because the $6 fees they took out i'll just have to take the loss I guess… still wondering where my ATM card went though

      I'm going to get this money out and go down to a branch to have this account removed tomorrow. Wont be ever visiting IMB again in my lifetime.

      hmm just tried on a computer it made me agree to some updated terms that appeared… then it let me transfer it out

    Lodged a complaint with the FOS on 2-Aug, and have not received any letter yet, but today $50 is in account with CREDIT TRANSFER (IMB MINI COMPETITION).

      goes to show that you cant just update terms and conditions on the fly to suit yourself. They definitely knew this but probably thought by rejecting a large amount of people vs the people that would take them to FOS would work out for them.

      I hope every single person does it. How many times has a bank or credit union used terms and conditions against their own customers to screw them? every single day! so they get what they deserve
