Terms and Conditions for $0 Variable Fee Promotion

When does the promotion run?

  • The promotion runs from 00:00 (AEDT) on 1 January 2023 and will be available for a limited time only, for as long as advertised on the eBay.com.au site (“Promotion Period”).
  • The promotion resets every 30 days starting 1 January 2023 until the end of the Promotion Period (each referred to as a "Cycle").

Who is eligible for this Promotion?

  • “Eligible Sellers” means sellers registered on eBay.com.au who:

    • have Australia or New Zealand as their registered address on eBay; and
    • have an active eBay Plus membership; and
    • Eligible Sellers must activate the promotion in each Cycle to receive the promotion during that Cycle. To activate this promotion, Eligible Sellers must have received an invitation to participate in this promotion and accepted these Terms and Conditions by either clicking “Accept offer” on the Terms and Conditions page or clicking “Get offer” under the “promotional offers” section of your My eBay account; and
    • received confirmation from eBay that “you’ve accepted the offer”.
  • Once you have accepted the offer, the promotion will be automatically assigned to your account and will be visible within My eBay.

  • The invitation to participate in this promotion is not transferable or exchangeable.
  • For the avoidance of doubt, if the promotion is not redeemed by the end of the Cycle, it shall be forfeited by you and the discount will not carry over into the next Cycle (if any). What is the Promotion?

    • newly listed on eBay.com.au during the Promotion Period (i.e. they cannot be relisted items through ‘Good ‘til Cancelled (GTC) or auto-renewal);
    • in multi-quantity or single quantity fixed price or auction format only; and
    • not listed in one of the Excluded Categories (as defined below).

  • The variable fees will be discounted directly from the eBay seller fees applicable to the Eligible Listings when they are sold.

  • This promotion only applies to the variable fees on Eligible Listings that are sold during the Promotion Period.
  • eBay reserves the right to cancel or change the offer at any time.

What exclusions apply?

  • Items listed in the following categories are excluded from the Promotion (“Excluded Categories”): Websites & Businesses for Sale (11759), Aircraft (63676), Boats (26429), Caravans, Motorhomes (32633), Cars (29690), Motorcycles (32073), Trucks, Commercial Vehicles (6049), Real Estate (10542), Services (316), Flights (3253), Tickets (1305), Travel (3252), Gift Cards (172009).     I was just in chat with eBay CS and they said something else is going to be offered this month. Of course it was vague and all I got was “February”, but we might get a nugg.

        Aditi was laying it on a bit thick, so I took the “better” with a barrel of salt. He even said because I was so great he’d “refer” me for the seller promotions, which made my arse feel very smoky.
        I really need their promotions to save every cent, I just had a $2000 vet bill 😑

    This promo is the only reason to actually sell on eBay. 14% is a killer, that's literally my profit.

      It depends entirely on what you're selling - if it's something more specialised then you need eBay to reach the global market.
      But if it's something locals around you will want to buy, then just use local methods like Gumtree or Facebook Marketplace etc.

        Bigger audience and buyers normally trust ebay more due to buyer protection.

        • Also, Facebook and Gumtree tend to be more "face to face" transactions. I don't know about you, but I'm not too keen to meet up with strangers to exchange money/goods.

          You could post the item of course, but question is do you want to take the risk of accepting PayPal on Facebook or Gumtree sales.

          You could insist on PayID/Bank Transfer, but then buyers won't be too keen to expose themselves to that kind of risk, so you might have less of an audience.

          You also have to put up with lots of low-ballers and time wasters.

          • @proudwanderer: Yes…eBay and PayPal have spent 15-20 years developing that trust, that is not being replicated elsewhere.
            It took time and also regulatory process to get there.

            I still remember the anti-PayPal movement*, when it started (eg. BoycottPayPal) because of some bad outcomes and fears of a 3rd party payment settlement system.

            Even with the high fees & PayPal scams (eg. PayPal siding with the buyer), people still prefer to use them to this day.

            *This also happened late in 2022, as PayPal was going to fine users $2500 for behaving "against their policies", eg. posting things online, protesting, etc.

    This is very annoying. I accepted the offer, had three items listed and now I don't even see this offer in my expired offers list. Also all the eBay emails where those offers were listed (usually titled "Your eBay Plus member savings") is dynamically loading a eBay page that have scrubbed out the offer so I can't prove to eBay I got the offer. Changing the email body content and the offers they contain after they have been sent out, should be illegal and I might report them to Fair Trading

      I’m in the same boat. The T&C’s clearly stated it was for February, and I accepted it on 31/01. Now it’s gone.

      If only I had thought to take a screenshot.

  • So I had the Jan promo and listed an item on the 31st. Just sold today and I see I've been hit with a $60 final fee!
    I thought if you listed in the same month you get the promo? (even if it sells in the next month).
    What's the chance ebay CS will apply the promo to the sale if I message them?

    • You should qualify for the $0.30 FVF, unless you forgot you used 3 up during Jan.

      Definitely call support.

      • hmmm, I know I have listed stuff in the past during promo period & sold after the promo had ended & still got the nil or $1.00 or whatever the promo fee was.

        It's possible they have changed this.

      The Jan promo for me ended on the 30th, even though the emails and tc's say 31st.

      You can try your luck with CS, but they range from good to incompetent.

      If that fee is a big deal to you consider cancelling the order and refunding the buyer (if CS can't help), maybe get in touch first and explain the situation.

        Yeah I've just noticed that as well. I'm 100% sure it said til the 31st of Jan when I accepted the promo, and it still says "as of 23:59 - AEDT, 31 January 2023" in the T&C's https://pages.ebay.com.au/sellplus3fvf/

        • Not really. It says the "offer" is no longer available "as of 23:59 - AEDT, 31 January 2023".

          Doesn't mean that the promotion "time frame" is up to and including 31 Jan.

          This is what I see in my "Expired promotional offers" section:

    Clearly, the promo was intended to be a monthly thing - hence the "resets every 30 days" part.

    Some frugal head honcho obviously decided to rescind the offer and it was pulled. A poster above (ChiMot) was even able to "ACCEPT" the offer for February just before it was pulled!

    • I managed to accept the offer on 30th Jan on another acc and it worked with an expiry date of 2xth February

      • Have you listed and sold anything in Feb from the one you accepted on 30th Jan - and were you charged FVF?

        Example:
        - List item on 2nd Feb
        - Sold item on 4th Feb

        • I was meang to say and forgot the following phrase afterwards:

          But the offer completely disappeared off the promotional offers tab as experienced by some others. I quickly changed my quantities to zero to avoid any high fees.

          Also when I accepted it, it was valid from the date I accepted it (30th Jan) till around the twenty-something of Feb.

      • I listed on middle of January and sold 4th of February and charge $0.3 fees only

        • I wouldn't count on this. Mine sold on 5th of Feb and I got hit with the full fee, about 15% of the sale! Customer service was adamant that it's only on items "that are sold during the Promotion Period"

          • @pixxelpusher: Try another customer representative, or just email back with the chat . They just make up the story and don’t want to refund the fees that shouldn’t be charged

              "the item is sold out side of promotion period and hence the fees had applied"
              then they pointed to the T&C's: "In the condition, it says "This promotion only applies to the variable fees on Eligible Listings that are sold during the Promotion Period."

              Maybe they're cracking down on it.

      • There's a number of points that I believe make this an invalid term. However, to challenge something like this and undo it would typically mean that a court would decide if this term is fair or not for both parties. Terms must be fair (https://www.accc.gov.au/business/selling-products-and-servic…). See Unfair terms in standard form contracts.

        I've been caught out with this as well, I accepted, saw that the offer term included all of February, and then cancelled a bunch of high value auctions and then relisted them. I only found out today that I now need to pay the variable fee and the promotion has been cancelled. The only way I could have known this would be via constant monitoring of the promotion.

        As a seller, no notificaiton was provided to me that the promotion was cancelled, I was unaware that Ebay executed their right to cancel or change the offer. Ebay notifies me about pretty much any event, why are promotions not an auto generated email sent or at the least a message posted on your ebay account. Should at a minimum get an email when you opt in, when it expires, and when ebay change it.

        In this specific case, having it only open for a few days, then suddenly changing it, without notice, means that a bunch of people have been sucked into advertising goods on Ebay thinking that the variable fee promotion has applied. Ebay's conduct here is inherintly unfair and I can't see how anybody could argue differently.

    Just talked to eBay CS and they wouldn't reverse the fee: "As per terms and condition it is clearly mentioned that – This promotion only applies to the variable fees on Eligible Listings that are sold during the Promotion Period."

    So seems like you do now have to sell within the promo period as well, so that's something to keep in mind. He did say another one was coming soon.

      I think it is hit and miss.

      Some people have said that they have only been charged $0.3 when "listed during promotion period" but "sold after promotion period".

      Whereas others have said that they get charged full fee.

      Firstly, eBay CS don't really have a clue - so hard to believe their "interpretation" of the T's & C's.

      Secondly, the T's & C's themselves are written in a way that isn't always very clear.

      Online eBay chat is pretty much hopeless most of the reps on there make things up as they go along.

      You don't have to sell during the promo period you can just end item/s and use sell similar to list them again just before the promo expiry date. That gives you another crack at it but make sure that you don't use relist though as that will void the promo.

      • I did do a fresh listing at the end of the month which sold start of Feb. But ebay said no as in the terms there is a line that says the item also has to be sold in the same month. They just kept pointing to that line in the T&C's

        • That's odd I've done that many times. When you go into your expired promos what's the start and end date on there. From memory the end date is not always end of the month I think it varies depending on when it was first activated. Then go into your listing and what's the start date on there.
