    Online retailer remedies misleading messages about warranties and refunds

    An online retailer of computers, software and electronic goods has amended its site and will consider some warranty claims after Australian Competition and Consumer Commission intervention.

    The ACCC raised concerns that representations made by Esel Pty Ltd, trading as Mwave at www.mwave.com.au, breached the Trade Practices Act 1974 because its warranties and returns policy contained misleading and false information about consumers' rights.

    The intervention continues the ACCC's focus on online traders who misrepresent consumers' rights concerning warranties and refunds.

    "Online traders should be aware that the ACCC reviews sites regularly and will consider action where remedial work is not quickly undertaken," ACCC chairman Graeme Samuel warned today.

    "Consumers have the same rights online as if they were to walk into a store. Basically, they can expect that a product would have a level of quality and performance that would be reasonable to expect, do what it is meant to do and match its description."

    The ACCC was concerned about statements to the effect that:

    Mwave does not provide any warranty and consumers must deal directly with the manufacturer;
    warranties arising from statute do not apply; and
    the consumer is required to pay any shipping costs incurred in returning the faulty good to Mwave.
    

    If it is necessary to return faulty goods to the place of purchase, the ACCC considers it reasonable for the seller to pay appropriate freight costs.

    The Act provides that consumers have certain statutory rights in respect of goods purchased from a retailer. For example, if a good is defective, the consumer may be entitled to request a refund from the retailer rather than accept an offer of replacement or repair. Such a right is usually available for a 'reasonable time' after the consumer received the good. Consumers are also entitled to seek a remedy from the retailer and need not be told that they must deal with the manufacturer directly.

    Mwave admitted its warranties and returns policy contained false and misleading statements about consumers' statutory warranty rights. It has amended its warranties and returns policy and will place notices on its website in its e newsletters explaining its conduct.

    Mwave has also agreed to consider warranty claims for faulty products purchased since 1 July 2007 where consumers were denied a remedy or may not have pursued a remedy because of Mwave's admitted false and misleading statements.

    A copy of the court enforceable undertaking provided by Mwave can be found on the ACCC's website, www.accc.gov.au. Undertakings are posted on the undertakings register which is available via the public registers link on the homepage.

      Yup. Limite offer = only accept the number of orders for the stock you're selling at that price.

      One of my colleagues attempted to order the router and got the full RRP shortly after I got my confirmation email, so they knew what they were doing.

      I'm reporting them to the ACCC. I've also emailed them informing them of such. This is deceptive at best. I understand the whole 'limited quantity' thing, but this is clearly a baiting situation.

      MWave, save face here and offer people who received confirmation emails the original price, or i'm sure enough people here on ozbargain will be teaming up with the ACCC. You don't make offers like this and then go 'oh oops sorreh!'

  • Mine so far seems OK, its in "Processing" status (completed order and paid for mine at 2:26pm). I had trouble deleting the "Mwave Priority transit Cover ($2.75)" when I order it, the response was way too slow, so just decided I'll just pay that extra amount. Maybe because I paid that little bit extra they are treating my order as "Priority" and giving it preference over others … who knows …

  • This has to be one of the most fail promotions ever to be posted to OzBargain. We have about a hundred people reporting order cancellations now and needing to go chase refunds, but only TWO people have reported receiving tracking numbers.

    If anyone wants to take things up with fair trading, you might also want to consider taking things up with PayPal too because the PayPal user agreement forbids them from charging their 1.5% surcharge (see my post on page 4). Dodgy practices shouldn't go unreported.

      Nah this isn't the most fail promotion on Ozbargain. $65 external hard drives anyone..I think twice… 100's of pissed off people who missed out on the HP tablets because HN staff were selling 6 at a time to their mates… uhm… COTD with their Haviana's which was followed up with their $199 netbook 3 cell battery fail. MLN taking 3 weeks to send out 24" Samsung BX2450's and refusing to provide refunds even though they took ages to send out. Those are just a few I know of and can remember. There have been plenty my friend.. but with that there have been 100's more awesome ones!

    IT IS NOT POSSIBLE TO REMOVE YOUR MWAVE ACCOUNT.
    I do not have a clear indication of the repercussions that are involved in this so just as a warning to all you folk out there, if you do not wish to make purchases with MWAVE.COM.AU in the future, be sure to put dummy information into your account details. For your sake I hope that you didn't use your priority email account to make the purchase as they now control that information you released to them and you cannot revoke it.

    I believe this is an ethical problem that may need to be fixed in the future as I am uncomfortable in the fact that I have little control over my personal details on this website.

    I got the cancellation email too, even though I had it in my shopping cart at 1:57 PM.

    mwave charges a huge 20% fee if you cancel your order.
    Can we charge them the same if they cancel our orders?

    Got mine cancelled as well. Had the item in my shopping cart by 2:20 PM but only managed to complete the transaction around 2:55 PM.

    Apology is definitely not accepted. They have lost a customer on both a personal and corporate level.

    Three friends and I all got our cancellation letter. Mwave wasted so many people's time and they have accquired our personal information for nothing. Now they can sell these information to marketing company and make money. What a fraud and time waster. We should all write complain letters to Australian Competition and Consumer Commission http://www.accc.gov.au.

  • I ordered at 2pm ESST and almost 45 mins later after the servers crashed, paid for my order. Never refreshed the browser, etc. Got the invoice, paid for it and got the cancellation email around 9pm last night.

    Rang consumer affairs in SA they suggested lodging an "unfair trading report". Just google it for the link. They can then investigate with other states.

    interesting that mily (about 15 posts above) ordered at approx same time and got one.

    I must have been damn close… or did mwave honour the Cr Card transactions before the paypal transactions??

    • This was what I thought before, when I have multiple choices on payment, I normally select the one that cost the less, such as Paypal. But yesterday when the thing was obviously not going smooth, I took credit card as a safer option as I can call my credit card company directly to call back the money when something was going wrong. Funny they have the same surcharge for both Amex and Mastercard (1.95%), and even surcharge on paypal (knew that later from comments), my choice was Amex as the MR points worth more and left mwave less profit on surcharge.

      • I paid with credit card as mily did. Ordered at 1.58pm, cancelled 10.15pm.
        How you paid has nothing to do with it, although looks like "priority shipping $2.45" may have had a determining factor.

    You should put in a job ticket to delete your account. I have.
    There are plenty of online shops out there, to buy hardware from.
    I do the ordering for our company, have spent a fair bit with mwave, well no longer.

    • Did they action it? I put in a ticket to delete my account and got a reply "This job has been answered/completed.".
      Alas, the only way to view that reply is by checking the Job Request Inbox in my Mwave account, which required me to login to the account they claim to have deleted…

    Folks we have the wrong angle this far,
    The issue is not lack of ‘Acceptance’

    But that the supplier continued to offer a product that it did not have stock of.
    I was only able to add to my cart at 2.15pm which from the above it seems clear that there was no more stock by that time.

    So Mwave continued to offer a product it did not have and in the process collect personal details.
    So
    1. is there a law against offering to sell a product you do not have?
    2. using the above false offer to collect personal details including in many cases CC details.

    I wonder who mwave source their wares from? Ingram Micro, Synnex? I'm sure they probably don't appreciate their resellers behave in ways like this so forward our complaint to them may amount to something. I'd say complaints to Linksys probably won't go astray either.

    My order's been cancelled too. Not happy at all. I just don't see why in this day and age of ecommerce, we still have to put up with having orders being cancelled, after 'paying' immediately by credit card.

    Where's their stock-tracking system? Do they really only update stock levels overnight, manually? If so, then they are in no position to be running these one-hour-only specials, that's just courting trouble.

    And if not, then the alternative is possibly a worse scenario. It means they've allowed all these orders to be accepted, with the intention of cancelling them afterwards, or at least with the knowledge that a good proportion of these orders will never be fulfilled.

    Either way, they have really shot themselves in the foot with this promo.

    I will be taking up the suggestion of submitting a complaint to the ACCC. Wonder if the NSW Fair Trading office will be interested in this too?

      • Not exactly zero, I got mine. Logged on by 2:01, put the thing in cart around 2:06 or later, paid by C/C around 2:15 and saw the confirmation page around 2:18, delivered this morning 8:35. Not sure how many people in total got the router like me, if less than 50 then I will revoke my Pos vote even I got a unit.

          That makes it worse since it would suggest that there was no order to the way they selected successful orders (since it's supposed to be first come first serve).

      What is the point to accept the orders and confirmed the ordered, and then just told all the customers that orders have been cancelled half day later?

      But if they had a half decent inventory management system, then they should not have been able to oversell as once the allocated stock had run out, it should have immediately changed to OOS and not allowed any further orders to continue - even allowing a margin of error, it shouldn't have occurred on the scale we are seeing here

        I agree to both of these. IF they had a better inventory system, but if they have to manually change the stock level to say 'Out of stock' I can imagine they would have had the same problems accessing the site as everyone else, ie 30 minutes to access a page.

        But this is all speculation, we can keep narrowing down the root of the problem but in the end it was a bargain if you managed to get one and its still a bargain if you didn't.

        People should look at the bright side rather than looking for someone to blame. Anyway ACCC complaints probably wont amount to much as MWave could claim that during that time they were DDoS attacked.
