        • Ok, we are in a physical store…

Yes you may have put that item in your shopping cart, and yes it's off the shelf. So what? Of course someone else can buy it- because you dont own it, the store does. Until they give you a receipt, you have no more rights to that item than me.

It wouldnt be very nice of me to take the item out of your trolley (it would be down right rude), but that's all it would be. For instance, you're waiting at the register like a normal person does to pay for your items. I walk past you and everyone else in the queue, pick up your items out of your trolley, get the lady to scan them, pay for them, then walk out. Now… that's inconvenient to you, but no law has been broken. Its up to the lady to say "sorry sir, I'm not selling you these items". She can refuse to sell me any or all of those items based on my actions, but if she doesnt- well thats bad luck for you (and very poor customer service).

The trolley is just a "holding device" for convenience when purchasing multiple items. Putting something in there doesnt obligate you to buy or give you special rights to the item, and technically doesnt stop anyone else taking items belonging to the store (different story if they take a handbag or something though). Because you know what would happen if someone did? You'd curse at them for wasting your time, and go back to the shelf for another one. Or you could protest to the store and explain what happened (especially if there are no more sale items on the shelf). But it would be up to the store to refuse to sell the item to them, not you.

And further to your last bit about 1.57pm etc…. again, the store can refuse to sell you any item. They are under no obligation to sell you anything. The pixels you put in your imaginary cart online is just a graphical representation of the item you intend to purchase. It's not a guarantee that the physical item is available for purchase. A physical shop could refuse to sell you a physical item too! Just because its in your trolley, doesnt mean they have to sell it to you. It's faulty, its no longer on sale, its the display model, its been reserved for someone else… any reason at all. You cant force them to sell it to you, just like they cant force you to buy it.

I'm not sticking up for MWave btw… my order was cancelled too. Just highlighting who owns what and when in a transaction.

      • Wow i had a lecture on this stuff yesterday.. you sum it up quite nicely!

        • Taking Business Law 100 at Curtin by any chance? This would be a good case study or discussion point. What about Business Information Systems 100? Do you think their information systems and technology infrastructure will help them create business value and gain competitive advantage (and address buyer power)?

        • Nope :P

    • I too got the cancellation email. But I know for sure that they had the stocks when I submitted my order and got the confirmation. I had even printed the confirmation screen, when my colleague started putting the order. However he received his router but I had received the cancellation.

I have confirmation email from mwave and paypal. The transaction is still shown in my credit card but the refund is not in yet.

They are already known to the ACCC.

The following page title "Online retailer remedies misleading messages about warranties and refunds"

    http://www.accc.gov.au/content/index.phtml/itemId/918525?pag…

  • Here is for you guys to have a read….. Sund00bie good find

Online retailer remedies misleading messages about warranties and refunds

An online retailer of computers, software and electronic goods has amended its site and will consider some warranty claims after Australian Competition and Consumer Commission intervention.

The ACCC raised concerns that representations made by Esel Pty Ltd, trading as Mwave at www.mwave.com.au, breached the Trade Practices Act 1974 because its warranties and returns policy contained misleading and false information about consumers' rights.

The intervention continues the ACCC's focus on online traders who misrepresent consumers' rights concerning warranties and refunds.

"Online traders should be aware that the ACCC reviews sites regularly and will consider action where remedial work is not quickly undertaken," ACCC chairman Graeme Samuel warned today.

"Consumers have the same rights online as if they were to walk into a store. Basically, they can expect that a product would have a level of quality and performance that would be reasonable to expect, do what it is meant to do and match its description."

The ACCC was concerned about statements to the effect that:

    Mwave does not provide any warranty and consumers must deal directly with the manufacturer;
warranties arising from statute do not apply; and
the consumer is required to pay any shipping costs incurred in returning the faulty good to Mwave.

If it is necessary to return faulty goods to the place of purchase, the ACCC considers it reasonable for the seller to pay appropriate freight costs.

The Act provides that consumers have certain statutory rights in respect of goods purchased from a retailer. For example, if a good is defective, the consumer may be entitled to request a refund from the retailer rather than accept an offer of replacement or repair. Such a right is usually available for a 'reasonable time' after the consumer received the good. Consumers are also entitled to seek a remedy from the retailer and need not be told that they must deal with the manufacturer directly.

Mwave admitted its warranties and returns policy contained false and misleading statements about consumers' statutory warranty rights. It has amended its warranties and returns policy and will place notices on its website in its e newsletters explaining its conduct.

Mwave has also agreed to consider warranty claims for faulty products purchased since 1 July 2007 where consumers were denied a remedy or may not have pursued a remedy because of Mwave's admitted false and misleading statements.

A copy of the court enforceable undertaking provided by Mwave can be found on the ACCC's website, www.accc.gov.au. Undertakings are posted on the undertakings register which is available via the public registers link on the homepage.

  • Those who received cancellation email, what emails did you get before the final cancellation email?

    • in my case, a paypal payment confirmation at the time of payment (2:24pm), and a "Thank you for shopping with mwave.com.au" at 2:57pm. Finally cancellation "Order Update" email at 12:37am this morning.

    • +1

order confirmation @ 1.59pm - and still no cigar.

  • +1

Just got this cancellation notice. They should have stopped taking orders when their stock ran out.

    Dear Mwave Customer,

Many thanks for placing an order for the Linksys E1500 as advertised with limited stock for the Rush Hour promotion. As you are aware this promotion directed an influx of customers to our website and there were some delays in processing your orders.

We would like to confirm that we are unable to fulfill your order for the Linksys E1500 as all of our stock was sold prior to us receiving your order.

    IMPORTANT PLEASE READ and ACTION:
Can you please respond with your Bank Account details to enable us to transfer the funds back to you.

Please accept our sincerest apologies and we hope to bring you another fantastic Rush Hour soon.

    • got the same email!

    • +3

Yup. Limite offer = only accept the number of orders for the stock you're selling at that price.

One of my colleagues attempted to order the router and got the full RRP shortly after I got my confirmation email, so they knew what they were doing.

I'm reporting them to the ACCC. I've also emailed them informing them of such. This is deceptive at best. I understand the whole 'limited quantity' thing, but this is clearly a baiting situation.

MWave, save face here and offer people who received confirmation emails the original price, or i'm sure enough people here on ozbargain will be teaming up with the ACCC. You don't make offers like this and then go 'oh oops sorreh!'

  • Order was not honoured. ("unable to fulfill your order")
Order placed and payed for by paypal by 2:24pm.
Well done to those who managed to get one. No luck for me :(

  • Have to give a neg to Mwave as a warning for their future "Rush Hour" deals

Wasted nearly an hour of my time trying to purchase this product just to get a cancellation as well

    Keep revoking the votes people

edit: haven't had to logon to OzB for a while so I am really annoyed

Got my order cancelled,Will never ever grab anything from this bloooody mwave.

  • Mine so far seems OK, its in "Processing" status (completed order and paid for mine at 2:26pm). I had trouble deleting the "Mwave Priority transit Cover ($2.75)" when I order it, the response was way too slow, so just decided I'll just pay that extra amount. Maybe because I paid that little bit extra they are treating my order as "Priority" and giving it preference over others … who knows …

    • Ditto, we can only hope.

  • My order went through at 2:20pm, just got the same email >:(

    at 11:31pm.

I guess its a quick way to get cash, before they had it back.

I would like to tell them where they can put their next RUSH Hour (or Rush 5 minutes) !!!

  • i think the general concensus is that if they havent shipped it and gave you a tracking number yet then you are been screwed around.

    • Simply appalLIN conduct from Mwave! ;)

  • Crappy company, crappy website, crappy service, crappy deal.
    Goodbye and good riddance mwave

  • This has to be one of the most fail promotions ever to be posted to OzBargain. We have about a hundred people reporting order cancellations now and needing to go chase refunds, but only TWO people have reported receiving tracking numbers.

If anyone wants to take things up with fair trading, you might also want to consider taking things up with PayPal too because the PayPal user agreement forbids them from charging their 1.5% surcharge (see my post on page 4). Dodgy practices shouldn't go unreported.

    • +1

Nah this isn't the most fail promotion on Ozbargain. $65 external hard drives anyone..I think twice… 100's of pissed off people who missed out on the HP tablets because HN staff were selling 6 at a time to their mates… uhm… COTD with their Haviana's which was followed up with their $199 netbook 3 cell battery fail. MLN taking 3 weeks to send out 24" Samsung BX2450's and refusing to provide refunds even though they took ages to send out. Those are just a few I know of and can remember. There have been plenty my friend.. but with that there have been 100's more awesome ones!

  • yesterday i got an email at 2:30 saying my order was received and then another email at 5:40 saying my payment was received so at the moment my order status is "Processing"
havent heard anything about mine being cancelled

    • Did you get an Order update email?

      • only the one saying the payment was recieved - nothing else so far

        • If you get payment was received notification, you are one step above the others who got order cancelled.

    • ditto - i received an email saying order received at 2:32 and an order update email at 5:42 saying payment was received. Havent heard anything re cancellation

  • They can't fulfill my order as well, my guess is that they
    - probably only had a few units for sale
    - achieved the PR about the company

    • bad PR if anything - they have stopped prospective customers from shopping there. I for one wont be giving them any business.

  • For all of those who wanting to call mwave up, well you're out of luck. They've setup their phone system as a IVR and just keep pressing buttons but you will never quite managed to speak to someone live a la Scoopon style. Hmmm I wonder why.

  • bad bad mwave…got my order in before 2pm and still telling me cant fulfill order. USELESS.

  • my order got cancelled

    • Why isn't your vote revoked then.

      Bastards these companies are.

      • how to revoke?

  • +2

i don't accept yr apology. i will just simply tell my every friend about this funny dodgy story. MWave u fark yrself up, well done.

  • I received an email saying cancelled order as well :(

  • +1

IT IS NOT POSSIBLE TO REMOVE YOUR MWAVE ACCOUNT.
I do not have a clear indication of the repercussions that are involved in this so just as a warning to all you folk out there, if you do not wish to make purchases with MWAVE.COM.AU in the future, be sure to put dummy information into your account details. For your sake I hope that you didn't use your priority email account to make the purchase as they now control that information you released to them and you cannot revoke it.

I believe this is an ethical problem that may need to be fixed in the future as I am uncomfortable in the fact that I have little control over my personal details on this website.

    • +5

you will change your mind if you placed the order successfully and paid for it, than received the cancellation letter half day later..

      • If that's the case, with the payment done, I agree with you. Ignore my comment above.

  • Bank details were requested for a refund!! pfft wasted 30 mins of my life..
I'd like to know if anyone here got their orders through..

  • +3

I got the cancellation email too, even though I had it in my shopping cart at 1:57 PM.

mwave charges a huge 20% fee if you cancel your order.
Can we charge them the same if they cancel our orders?

I'm never buying anything from them again. Ever.

  • +2

Got mine cancelled as well. Had the item in my shopping cart by 2:20 PM but only managed to complete the transaction around 2:55 PM.

Apology is definitely not accepted. They have lost a customer on both a personal and corporate level.

    Added my Neg.

    • I really wouldn't mind the apology if they paid me a 20% "cancellation fee" with my refund :-)

Since "exit" fees are so common in Australia, is there any chance we can get them to pay?
That will also ensure they never behave like this again.

  • +1

Got my order cancelled also. NEGATIVE
    Ordered at 230pm

  • +1

Three friends and I all got our cancellation letter. Mwave wasted so many people's time and they have accquired our personal information for nothing. Now they can sell these information to marketing company and make money. What a fraud and time waster. We should all write complain letters to Australian Competition and Consumer Commission http://www.accc.gov.au.

    • Thanks. Just put a neg in there as the whole thing was a neg wasn't it! Cheers.

  • I ordered at 2pm ESST and almost 45 mins later after the servers crashed, paid for my order. Never refreshed the browser, etc. Got the invoice, paid for it and got the cancellation email around 9pm last night.

Rang consumer affairs in SA they suggested lodging an "unfair trading report". Just google it for the link. They can then investigate with other states.

    http://www.ocba.sa.gov.au/about/compliance/complain.html

I think they should offer a discount on a similar item.

    General complaints form.

    • Awesome. Complaint left.

    • Can we all sign on it? At least you can give this link to them.

  • +1

If they say it's out of stock, why are they still allow me to add it to cart NOW??

    • Can you send the link please? I can't see it anywhere…

    • It says you can pre-order it now…

      • +1

When I did mine, not pre-order, they got stock at that moment. And even it's pre-order, it allowed us to order, why did they all cancelled at the same day?

    • +1

      That's the point!

  • +3

Got my order cancelled also. NEGATIVE

  • +1

Got mine cancelled too. Just try to grab ppl attention. Will never buy from them anymore.

  • +1

Cancelled my order! Was instock when I put it in cart and processed it. The dogs!

  • paypal transaction at 14:16:04 AEDT but I've got the rejection email too.

interesting that mily (about 15 posts above) ordered at approx same time and got one.

I must have been damn close… or did mwave honour the Cr Card transactions before the paypal transactions??

    • This was what I thought before, when I have multiple choices on payment, I normally select the one that cost the less, such as Paypal. But yesterday when the thing was obviously not going smooth, I took credit card as a safer option as I can call my credit card company directly to call back the money when something was going wrong. Funny they have the same surcharge for both Amex and Mastercard (1.95%), and even surcharge on paypal (knew that later from comments), my choice was Amex as the MR points worth more and left mwave less profit on surcharge.

      • I paid with credit card as mily did. Ordered at 1.58pm, cancelled 10.15pm.
How you paid has nothing to do with it, although looks like "priority shipping $2.45" may have had a determining factor.

        • No I didn't pay the priority shipping thing.

    • my paypal payment is dated "8 Mar 2012 13:59:23 AEDT"

  • Can anybody reminder me, it was 1st April yesterday?

  • +2

Mine got cancelled also. Mwave is on my do not buy list now.

    • +2

Revoke your + vote mate, mine got cancelled too even though my order was at 2:05.

Bait advertising, only 2 or 3 people in here report to get it so far. A big FFFFFFFFFFF………..UUUUUUUUUU….. to you Mwave.

      • Yeah I revoked. I've never had to do that before so took me a few mins to figure it out. :D

        • Pity you can't neg after revoking. Otherwise this "deal" would have more negs than +ve's lol

  • +1

Mine got canceled today, after almost 24 hours. Another one that will never buy from Mwave…

You should put in a job ticket to delete your account. I have.
There are plenty of online shops out there, to buy hardware from.
I do the ordering for our company, have spent a fair bit with mwave, well no longer.

    • Did they action it? I put in a ticket to delete my account and got a reply "This job has been answered/completed.".
Alas, the only way to view that reply is by checking the Job Request Inbox in my Mwave account, which required me to login to the account they claim to have deleted…
