    Folks we have the wrong angle this far,
    The issue is not lack of ‘Acceptance’

    But that the supplier continued to offer a product that it did not have stock of.
    I was only able to add to my cart at 2.15pm which from the above it seems clear that there was no more stock by that time.

    So Mwave continued to offer a product it did not have and in the process collect personal details.
    So
    1. is there a law against offering to sell a product you do not have?
    2. using the above false offer to collect personal details including in many cases CC details.

  • Having a crack at ACCC is good but anyone thought about a different approach?

    I wonder who mwave source their wares from? Ingram Micro, Synnex? I'm sure they probably don't appreciate their resellers behave in ways like this so forward our complaint to them may amount to something. I'd say complaints to Linksys probably won't go astray either.

    My order's been cancelled too. Not happy at all. I just don't see why in this day and age of ecommerce, we still have to put up with having orders being cancelled, after 'paying' immediately by credit card.

    Where's their stock-tracking system? Do they really only update stock levels overnight, manually? If so, then they are in no position to be running these one-hour-only specials, that's just courting trouble.

    And if not, then the alternative is possibly a worse scenario. It means they've allowed all these orders to be accepted, with the intention of cancelling them afterwards, or at least with the knowledge that a good proportion of these orders will never be fulfilled.

    Either way, they have really shot themselves in the foot with this promo.

    I will be taking up the suggestion of submitting a complaint to the ACCC. Wonder if the NSW Fair Trading office will be interested in this too?

      given that people were able to order before 2pm, and mwave could not even fulfil the early orders, then the people who ordered on or after 2pm had zero chance of buying one. i think that is worthy of an accc complaint.

      • Not exactly zero, I got mine. Logged on by 2:01, put the thing in cart around 2:06 or later, paid by C/C around 2:15 and saw the confirmation page around 2:18, delivered this morning 8:35. Not sure how many people in total got the router like me, if less than 50 then I will revoke my Pos vote even I got a unit.

          That makes it worse since it would suggest that there was no order to the way they selected successful orders (since it's supposed to be first come first serve).

        • Or in the order of first come first serve, but from the point of cash/incoming transaction.

      if Mwave cannot cater so many orders - no problem, then just reject the orders and said SOLD OUT right after it was sold out.

      What is the point to accept the orders and confirmed the ordered, and then just told all the customers that orders have been cancelled half day later?

      But if they had a half decent inventory management system, then they should not have been able to oversell as once the allocated stock had run out, it should have immediately changed to OOS and not allowed any further orders to continue - even allowing a margin of error, it shouldn't have occurred on the scale we are seeing here

        I agree to both of these. IF they had a better inventory system, but if they have to manually change the stock level to say 'Out of stock' I can imagine they would have had the same problems accessing the site as everyone else, ie 30 minutes to access a page.

        But this is all speculation, we can keep narrowing down the root of the problem but in the end it was a bargain if you managed to get one and its still a bargain if you didn't.

        People should look at the bright side rather than looking for someone to blame. Anyway ACCC complaints probably wont amount to much as MWave could claim that during that time they were DDoS attacked.

    • Same here ! Tracking won't work for a while as the courier's systems are updated (mid-day or EOD) but i guess i am getting the router after all!

    There was a case that Dell mistakenly priced a monitor as $15 and received 140,000 orders. The court ordered dell to honor the order and people actually got their monitors for $15. This case might be a good reference in this situation.

      Wasn't in Aus though, so no precedence here unfortunately - plus, that was a mistake, this was not - Mwave advertised these items at the said price

    So recap…. 2 people have reported the deal as a success?

    I think the arguement of insufficient quantities is really starting to stack up.

    Originally over 200 plus votes here, plus this offer went out via email to all their customers (thousands on mail list?), and then this offer was most likely spruked by other bargain sites and forums as well?

    Even if 100 units were available (I doubt it), no way that's sufficient quantities.

    And they cant claim ignorance either…. advertising an item for $0 like they did, or course demand is going to be huge.

    I think a few official complaints through Fair Trading (yes I know more time wasted), may yield some positive outcomes for all concerned.

        I can see the edge of invoice behind that letter, and also there's another edge of the route box under the invoice. Well, ravipart can still go harvey norman and purchase a router and then make the whole thing up, but what's the point?

        • No I didn't pay the priority shipping thing and still got it this morning. And I have a feeling that they might filter those orders paid or added to cart before 2pm, though the price changed prior to 2pm, the deal was supposed to start at exactly 2pm.

  • Haha, I sent a request asking how what they did was not bait advertising and asking for my order to be completed and they just marked my case as resolved without saying anything.

  • Got the cancelled order refund via bank deposit email. Also received order completed and shipped email. Followed by another cancelled order refund via bank deposit request :P

    Got error message(server error) after selected PayPal as payment method(about 2:20pm)
    Paid via PayPal at 2:44pm
    (both deleted the $2.75 stuff)
    Received the thank you letter from mwave at 3.01PM, status changed to Waiting
    Received the Order Update letter from mwave at 5.11PM, payment received(PayPal), status changed to Processing

    Hope they mine one won't be cancelled.

    looks like they canceled mine. but i had to email them asking what the status is. they said they haven't charged my card buy i paid by paypal and the costs were deducted.

    just lodged a complaint with fair trading

    it seems if a fair amount of people whose order got canceled cause they didn't have the stock then they can get done for bait advertising

    Ordered and received "Invoice" by 2:43pm. It states "Your order will be promptly shipped as soon as the product arrives". Got an update at 9:48pm "unable to fulfill your order as all our stock was sold prior to receiving your order". Surely you don't take orders unless you can fill them. They should state "OUT OF STOCK" when orders exceed their stock! Bad form mwave, bad form.

      Login into your account and change the delivery address/phone # info to something silly. Email them and tell them to remove your details from their system.

  • The only plus all through this is the 1 hr and 10 mins of laughs I had yesterday while trying to place order. Flicking between mwave and OzB reading comments from frustrated Ozbers was hilarious ….. and stressful.

    I spent an hour desperately and finally grabbed this deal on mwave.com.au and now I received an email from them saying they can not fulfil my order because it was oversold the stock ! Isn't that crazy that I got a confirmation in the end that my order was successfully processed and also I received an email invoice acknowledging that the order was placed successfully…..

    After placing the order in the end I felt It was worth spending an hour on it, but now I am thinking that I have been fooled !! I might just contact the ACCC and see if they can help me deal with these mwave dictators !

    If you are going to put these deals on, make sure your ordering system can actually allocate stock before you charge.
