I actually started ordering mine about 15 minutes after the start of the deal. Website was really slow but I was taking my time as well. ended up placing the order around 50 minutes past.

I have not as yet, I suspect due product being in my cart by 2.3X pm, however because of downed website (their equipment failure) took until "2:42 PM (6 hours ago)" to get my proforma invoice from them, according to Gmail.
What does "Backorder" mean?
Backorder means that we do not have stock on hand and we have ordered from our supplier but we have not been advised of an Estimated date of arrival (ETA).
I basically be happy to wait 1 or 2 weeks for Mwave to fix the "supply matter" w/ wholesale, do the correct thing honor the promo deal so that I may happily claim my rebate within the period .
They can probably learn a thing or two from NetPlus. The last couple of times they've got those Kingston RAM on special, while admittedly their website didn't crash to the same extent as mwave's but their rep was actually keeping everyone up to date re stock/order levels and answer questions relating to the website (they had some issues there and everyone just F5 it the whole time) or how to apply the code etc. Now that's customer service.
Hell if mwave came here and formally announced oh noes we ran out of E1500's, I think they could've avoided a lot of grief on their end cancelling orders AND saves us the needless frustration of putting up with their massively DDOS'ed website.

Yeah, the Proforma Invoice sent via email (at 3:00pm) has a date/time of "3/8/2012 10:59:32 PM". So the invoice date was 8 hours ahead of Sydney (which is UTC+11:00). So one of their servers has an incorrect time.

Only two people in this thread reporting their order has been confirmed/shipped, but dozens reporting their orders have been cancelled — from that sample one can only infer that there were barely any units to begin with. Safe to say this promotion has been an utter FAIL from Mwave, and they deserve to take a reputation hit for this shameless attempt at self-promotion.

Only two people on OzBargain have reported their order has been shipped, but dozens have had their orders cancelled — generally on offers like this we get many more OzBargainers reporting success, so there can't have been many units at all. My guess is 10 units or less, and probably less than 5, which would mean this was never a bargain by OzBargain standards.

Same here. I paid from PayPal and I received all the confirmations from Mwave as well. But then now I have received an email from them saying that my order was cancelled. I managed to submit my order by 2.01 p.m. My work colleague sitting next to me submitted his order about 1 - 10 minutes after me and he has received his router this morning.
The difference is that he paid from Credit Card and I paid from PayPal. So that means even if you submit your order earlier they Cancel it if you had paid it from PayPal. If they had mentioned that in their web site I would have paid it from CC.
Well theres two things that make the credit card a more appealing transaction:
1. Higher bullcrap charge to process so MWave get a few bucks more
2. Harder to refund CC due to bank charge

I knew attempting to buy this was not going to be easy, most companies will not have the infrastructure to accommodate the amount of people that logged on today nor would it be feasible to have the infrastructure in place for a possibly once off occasion. Just like with any website that has a massive discount or free stuff no matter what they do they are going to be swamped.
Also no one said that there was going to be 1,000,000 of these units, thus they only have a set amount that is bound to run out at some point. Now please remember that an advertised sale price is not a legally binding contract rather an opening bid to tender.
BUT I personally do think it's wrong to cancel an order that has been paid for but there is not always another option, im assuming it was a glitch on the server due to the amount of traffic. If my order gets cancelled ill expect a refund and an email apology and nothing more.

It was in my basket BEFORE 2PM (11am WST) and I had received an email CONFIRMATION OF PAYMENT BEFORE 2:03PM. They may not have charged my credit card but they made some sort of confirmation of sale / purchase. Is there any legal action we can pursue against them, on principle?
I don't care how many they really had, making a purchase within the first few minutes of the sale and having that transaction complete should stand for something, and they should honour (even at a cost). If not can Ozbargain blacklist them from Ozbargain? That would be some sort of retribution.

People often get confused thinking that when a company advertises online and you decide to buy the item that it's somehow "offer" and "acceptance"… but its not.
It's "Invitation to treat".
The "offer" part comes from you when you offer to buy for the advertised price by giving your purchase details. The company still has the right to "accept" your offer (or decline it in our case).
It's the same when you go into a shop and buy an item.
If it's on the shelf, it's an invitation to treat. You go to the register and 'offer' to buy it. The retailer is under no obligation to sell the item to you (just like you are under no obligation to buy it just because its in your trolley).
The only real course of action is to prove they didnt have a reasonable amount of items available to purchase…. but good luck with that.
They are shooting themselves in the foot PR wise, but legally theyve done nothing wrong.

The real question did they have sufficient stock to reasonably meet demand, ie: was it a case of bait advertising. I don't think "limited stock" fully them indemnifies them against not having reasonable stock.

If they only had 5 items available for purchase, then its most certainly bait advertising- but unless you know someone at MWave who's prepared to hang them out to dry, it's not going to happen.
Also, it would be very hard for MWave to claim ignorance when offering such a deal… they basically advertised the item for $0. Of course demand would be huge on such an offer, and going by the 200+ votes just on this site (and ignoring the other bargain sites that would have also caught wind of this deal), hundreds or people would have registered their interest in this item. Not having sufficient quantities (and then not offering rainchecks) definitely raises big questions when not satisfying reasonable demand.
10, 15, or even 50 items wouldnt be classified as 'reasonable'…. as they started advertising this special days earlier via email (and their mailing list would be thousands).

Yes you may have put that item in your shopping cart, and yes it's off the shelf. So what? Of course someone else can buy it- because you dont own it, the store does. Until they give you a receipt, you have no more rights to that item than me.
It wouldnt be very nice of me to take the item out of your trolley (it would be down right rude), but that's all it would be. For instance, you're waiting at the register like a normal person does to pay for your items. I walk past you and everyone else in the queue, pick up your items out of your trolley, get the lady to scan them, pay for them, then walk out. Now… that's inconvenient to you, but no law has been broken. Its up to the lady to say "sorry sir, I'm not selling you these items". She can refuse to sell me any or all of those items based on my actions, but if she doesnt- well thats bad luck for you (and very poor customer service).
The trolley is just a "holding device" for convenience when purchasing multiple items. Putting something in there doesnt obligate you to buy or give you special rights to the item, and technically doesnt stop anyone else taking items belonging to the store (different story if they take a handbag or something though). Because you know what would happen if someone did? You'd curse at them for wasting your time, and go back to the shelf for another one. Or you could protest to the store and explain what happened (especially if there are no more sale items on the shelf). But it would be up to the store to refuse to sell the item to them, not you.
And further to your last bit about 1.57pm etc…. again, the store can refuse to sell you any item. They are under no obligation to sell you anything. The pixels you put in your imaginary cart online is just a graphical representation of the item you intend to purchase. It's not a guarantee that the physical item is available for purchase. A physical shop could refuse to sell you a physical item too! Just because its in your trolley, doesnt mean they have to sell it to you. It's faulty, its no longer on sale, its the display model, its been reserved for someone else… any reason at all. You cant force them to sell it to you, just like they cant force you to buy it.
