    According to the advertisement it's supposed to be the 16GB USB drive for $9.98 https://www.dicksmith.com.au/super-saturday. When I clicked on the link earlier this morning it took me to the 32GB USB drive which was advertised for $39.98 save $20 just as it's advertised on eBay http://www.ebay.com.au/itm/EMTEC-S550-32GB-USB-3-0-Flash-/25….

          Not too sure about paying by Paypal, but most probably you will get automatic refund via Paypal regardless.

    Definitely an error- the 'sale flyer' should list the usb 2.0 16gb emtec for $9.98.
    Click & Collect for best chance of it being honoured.

    You can even type 'emtec 16gb' in the dicksmith search bar and this listing will come up.

    There's none left, because my friends in the Victorian Premier's Office snapped them all up. They told me it was for some movie club they've got going there.

  • Did anyone receive $2 delivery? $2 delivery was supposed to end Friday 17th October and I would have assumed it would have ended at 11:59PM AEDT. This deal was posted ~ 10:45PM AEDT. It's not worth arguing over $2.95, but I'm sure some will.

      Let me assure you that come tomorrow morning, the complaints will not be over the delivery charge.

      • They may honour it, who knows, just like Myer honoured the Dyson deal earlier on in the day. It just seems like a lot of people are ordering via click & collect and there is only so much stock at store level. It will end in tears for many.

      They won't do any thing. The retailers have an escape clause in the T&C which states orders can be cancelled due to a pricing error.

      I recd the same error for 2 stores but continue paying via paypal and you will be fine. Basically ignore error.

    According to Competition and Consumer Act 2010, business has the right to reject a transaction BEFORE it has taken place due to pricing error, ( before they take your money for the product). However, once you have PAID for the publicly advertised price they must honour it by law. So in this case Dick Smith can't get away with their "Exclusion Clause" stated in the Terms & Conditions. (Law student from Melb Uni )

      We could be up for some paperwork and lot's of time if they don't honour deal. It's not really worth wasting too much time and headaches on as long as they refund money in a timely fashion. Even if they gave everyone this model but in 16GB capacity that would still be ok, just not the crappy usb 2 version.

      Ah the wild call of the law student. So lets say there is a contract (there almost certainly isn't because the two parties have a different idea of what's being sold, but lets go ahead and say there is), and evil evil Dickie's breached it. Fair Cop… now you're going to have to somehow show damages BEYOND a simple refund, that somehow Dickie has caused you quantifiable harm that can only be redressed by something other than the purchase price. Frankly I'd love to be in the court when something like this comes up. Judges are notorious for LOVING it when people waste their time.

        Superfred is talking about a breach of statue, not contract law.

        And anyway, a contract has been formed regardless - Dick Smith made an offer to treat and the customer accepted it and paid. Contract sorted. But yes, if their T&Cs as part of their contract provide reasons to exit the contract then they can. That's where the statue comes into play, where parliament have set a higher standard than contract law.

        • I think you might mean statute there sport. However contract formation is sadly never that cut and dry, and there have been many cases stretching back hundreds of years on that very subject. Contract lawyers will never have to worry about running out of contract formation cases, trust me.

    • Additional note: feeling super duper disapppointed and grumpy you couldn't capitalise on a price error may not be, at law, a sufficient show of damage. Just saying.

    • As a law student, you would be aware that lawyers don't refer to entire Acts but to specific section/s. What section are you referring to?
